2nd edition of the book “Civil Liability – New trends”
IDP teachers, Nelson Rosenvald, Atalá Correia and Adisson Leal, launch the 2nd edition of the book “Civil Liability - New Trends”.
“The topic of “civil liability” is one of the most intriguing in Law. Yesterday and today it challenges countless perspectives, increased all the time by the hypercomplexity, uncertainties and mutability of social phenomena. The possible overcoming of the assumptions of civil liability and its functions is even discussed. The initiative behind this book, bringing together renowned professors and researchers, had no other purpose than to encourage continued debate on this rich and difficult topic.
Donal Nolan, Professor of Private Law, University of Oxford, in an elegant preface, provides the entire academic community with an intriguing comparative approach. The author clearly highlights that the “tort” concept cannot, without due reservations and nuances, be transported to the “Civil Law” system. Within the scope of “Common Law”, it highlights the vigor and scope of “duty of care”, concluding that the proposal of this book has a lot to contribute to comparative law. Although legal systems have their specificities, contributions are reciprocal and desired.
Aiming only at a better organization, we divided the work into the following groups: a) principles and foundations of civil liability; b) assumptions and modalities of civil liability; c) environmental civil liability and consumer relations; d) civil liability in family law; e) civil liability in the medical field; f) civil liability of cigarette manufacturers; g) civil liability of notaries and registrars; h) civil liability of the State. Like any choice, we assume the natural risks of other possible proposals. In any case, we emphasize that, for this division, we use the preponderant themes, without disregarding the transversality of the subject”.
