IDP professor launches book on “democracy and respect for the law”
The second edition arrived at bookstores at the beginning of February
IDP Professor Bruno Torrano launched the 2nd edition of his book “Democracy and Respect for the Law” at the beginning of February. In the work, the Professor explains misunderstandings about legal positivism that are still widespread in Brazilian doctrine and jurisprudence and, thus, helps us visualize which theses of this relevant theory of law are useful for clarifying and improving our legal practices.
The IDP Professor, a master in State Philosophy and a master in Business Law, says that he arrived at the theme of the work after studying Brazilian Post-positivism in depth. “I realized that Brazilian Post-positivism is a theory that, in addition to overestimating its own capabilities and achievements, gives judges various rhetorical devices to give the appearance of legality to arguments that, in reality, are nothing more than personal predilection” , explains the Master
For the Professor, the work has two objectives. “The work has the dual purpose of recovering the theoretical dignity of legal positivism and asking magistrates to once again take notions such as institutionality and authority of law seriously. In short, the work asks people to stop repeating the mantra “we are in post-positivist times” if this only serves as a rhetorical and quick way of getting rid of the duty to be guided by rules and respect legal-constitutional planning.” , complements the Teacher.
The master adds that living in a learning environment like IDP has helped produce the second edition of the work. “In this second edition I added explanations and examples that arose from the questions and provocations formulated by my dear IDP students, besides Professor Paulo Gonet kindly agreed to elaborate the preface,” concludes the teacher.
