“Fake News” , a new book by judge Paulo Brasil Menezes (Maranhão Court of Justice), was released last Friday, 6/11, during Black Friday from the publisher Juspodivm . With a preface by Francisco Balaguer Callejón, professor of Constitutional Law at the University of Granada, the work addresses disinformation in the global situation, developing the study of fake news in three areas: modernity, methodology and regulation.
Paulo Brasil Menezes reveals that as the internet has contributed to the democratization of cyberspace, information manipulation has been improved. “Knowledge of global facts has increased, also attracting the spread of fake news through social networks, becoming a serious problem in contemporary democracies”, he points out.
For the author, such phenomena are paradoxes of modernity, requiring a systematic analysis of their impact in the 21st century, their structural performance and, mainly, their supervision in current times.
The judge highlights that, within the scope of the TJMA, the theme is part of goal 4, among the 28 listed by the current administration, which established the "Fake News is Not Legal" campaign, to combat the sharing of false news in the workplace and in society. society in general.
PARADIGMATIC CONSENSUS
“Fake News” aroused positive criticism from national and international jurists, such as Wolfgang Hoffmann-Riem, Professor Emeritus of Public Law at the University of Hamburg and former Judge of the German Federal Constitutional Court. “Paulo Brasil Menezes, in a clear and differentiated way, analyzes these manifestations and studies the capacity that disinformation has to distort the ecosystem of online discourse, as well as to hinder the functioning of democratic processes. Therefore, this book deserves a lot of practical and scientific attention”, he recommends.
In the analysis of Robert Ahdieh, juris doctor from Yale University, dean of Texas A&M University School of Law, USA, the book suggests the need for a 'paradigmatic consensus' for pluralistic societies and highlights the critical role of social institutions in navigating the contingency of an unstable news environment and in defense of information. “It’s essential reading, he concludes.
Menezes is a judge at the 1st Court of the District of Coelho Neto, Maranhão. Master in Fundamental Rights from the Faculty of Law of the University of Granada (UGR/Spain) and in Constitutional Law from the Instituto Brasiliense de Direito Público (IDP/DF). He worked as a visiting researcher at the “Peter Häberle” Constitutional Law Research Center at the University of Granada. He is a member of the International Association of Constitutional Law (IACL-AIDC) and an effective member of the Brazilian Association of Constitutional Procedural Law (ABDPC).
