IDP student publishes article in UERJ Magazine
The 9th semester student of IDP João Paulo Resende published the article “Economic Analysis of Litignce - Basic Assumptions and the 2015 Code of Civil Procedure” in the Electronic Journal of Procedural Law of the State University of Rio de Janeiro.
Check out a summary of the article below:
"With the aim of making litigation in Brazil more efficient, bringing it closer to socially desirable levels, the 2015 Civil Procedure Code provided for or improved four important procedural institutes: conciliation and mediation; precedent system; fines and succumbing fees; and attribution of binding effects to outstanding appeals with general repercussions based on the theoretical basis of the Economic Analysis of Litigation and through applied research, adopting the method. hypothetical-deductive, it is concluded that, even though the aforementioned institutes did not immediately result in an improvement in litigation rates in the country, they present themselves as mechanisms for discouraging frivolous litigation, including merely delaying appeals, by seeking solutions self-compositions, minimize optimism bias and reduce information asymmetry."
The economist, who is in his second degree in Law at IDP, tells how he arrived at the topic of the article. “The inspiration was the lack of articles on analysis, with quantitative data, about the effectiveness of the Civil Procedure code. One of the main objectives of the Law was to make the levels of litigation in Brazil, which are currently very high, more effective. The article set out to evaluate the impacts of this Law from this perspective”, comments the student.
The economist ends by explaining the process for publishing the article. “The article is the result of the IDP Scientific Initiation Program. I was a scholarship holder and my advisor, co-author of the article, guided me in the construction of the research problem. I already research in the area of Economic Analysis of Law and Civil Procedure, he was also researching in the area and we ended up creating the article together. After presenting the article at the IDP, we approached the UERJ magazine to publish the article, they only requested some formal adjustments and published it last week”.
For IDP Professor, Union Lawyer and João Paulo's advisor, Victor Guedes Trigueiro, publishing articles during graduation is of great importance. “For those who are interested in investing in research and are interested in the academic area, the sooner the student wakes up, the better. At the end of the course, the student will already have experience, will be able to complete the TCC easily and will certainly have advantages at the beginning of their career”, explains the teacher.
